Question: How do I explain that my mental difficulty limited my being able to function within the statute of limitation period. Also , although I suffered a heart attack The 6th January 2016, I was not until the Spring of 2018 after having an ablation that I was told that sixty percent of my heart was dead because of the Atorvastatin that I was prescribed.

In my present situation, I am not seeking an annual membership.
I am only seeking the right approach to be able to over rule the two year limitation period which in my case is not fair eg. My Ablation was recommended in 2017, and the procedure was done in the Spring of 2018.The liver damage that I suffered was not diagnosed until 2019, and I am still awaiting another diagnosis for continued complications that I am presently suffering.
It must be noted that in my particular case, all my medical appointments have been spread out far beyond the two year period, and all the Doctors that attended to my care agree that the Atorvastatin has damaged me severely.

Brief Answer:
Regarding the disability limitation you should consult a lawyer.

Detailed Answer:
Hello and Welcome to ‘Ask A Doctor’ service. I have reviewed your query and here is my advice.

I understand your concern dear.

Atorvastatin is a medication with many side effects.

One of the common side effects is muscle wasting and muscle breakdown which can be related to heart damage.

This medication may also cause liver damage, but this is very rare.

Regarding the disability limitation, I suggest you to consult a lawyer at this point.

You should consult a lawyer that is willing to take your case.

To confirm the disability I recommend doing the proper examinations that confirm the liver damage such as liver enzymes level and billirubin level.

I also recommend a consultation with a gastrologist which can give you a full report of the liver damage.

Hope I have answered your query. Let me know if I can assist you further.

My seeking help is to be able to explain myself with the right words to bring attention to the fact that because my heart is sixty percent damaged, it is only working at forty percent and as a result my brain function is compromised. In addition, because all medical examination was spread out beyond the two year limitation period, the statute of limitation period should not apply to my situation.

Brief Answer:
To confirm the heart disease I suggest the following examinations

Detailed Answer:
Hi again dear,

In my opinion the only way to bring attention to your medical condition is through examinations.

To confirm the heart disease I suggest the following examinations:

Blood tests

Chest X-ray

Electrocardiogram

Echocardiography

Exercise stress test

After the examinations you should consult a cardiologist who can give you a full report of the cardiac disease.

This would help to confirm that the limitation period should not apply to your situation.

Hope it helps dear.

Take care,

Dr.Dorina Gurabrdhi
