My position is that every test I failed at completely mimicked the symptoms of my injury. Every one. But, DA is under pressure to prosecute ALL DUI arrests bc it's better for them if they prosecute and lose, instead of dismissing and/or bargain. (FYI: My offense was driving with my blinker on!) So now $25,000 in legal fees later I am going to court for trial. (By the way, I allowed to get charges dismissed w/ accelerated rehab course once in my lifetime, which, of course, is probably the smart thing to do, but it isnt the right thing to do BC I was NOT impaired. I just refuse.) I am not asking you to be a police officer or judge, but I do have one toxicology question and one med question: When I was arrested, I had not urinated for about 4 hours and I had to go bad. The officer would not let me until I gave my urine specimen, which I did. Later, I was told that proper protocol is to let someone void bladder once BEFORE a urinalysis. That wasn't done. I believe it would have made a difference. QUESTION: 1) is that right? and 2) I have read that lab results at levels so low as mine were are completely unreliable. Agree? I am sorry to inform you that the defence is not strong and this is right to ask someone to not void bladder before urinalysis. Even if they have allowed you to void probably results will not be different from current one. Low concentration in urine compare to blood level is not surprising and it often occurs in this way. High BC is infocative that there was alcohol in body.
Regarding your second question I do agree that there are false positive results and chances are much more at threshold concentration level.
