Question: I SLIPPED AND FELL AT WORK. THE MRI SHOWED I HAD 2/HERNIATED DISK ON MY LEFT SIDE. THE DISPUTE MANIFEST FROM MY AGE AT THE TIME OF THE ACCIDENT. HOWEVER, I WORKED AT 100% EVERYDAY, PUT IN 2-3 HOURS OF OVERTIME WEEKLY PRIOR TO CLOCKING IN AT MY WORK STATION WHERE I THEN WORKED 12-14 ADDITIONAL HOURS. MY WORK LOGISTICS HAS BEEN AS SUCH FOR A PERIOD OF 6-7 MONTHS PRIOR TO THE ACCIDENT. I WAS 57 WHEN THE ACCIDENT OCCURRED. HOWEVER, NOT WAS WRONG WITH MY BACK.
DOING THE PRE EXAMINATION FOR THE JOB I WAS CLEARED TO WORK BECAUSE OF MY BACK, ABILITY TO BEND, SQUAT, STAND FOR LONG HOURS. WAS APPROVED. I WAS APPROVED TO WORK DUE TO MY GOOD HEALTH. I PASSED ALL THE BACK TEST AND NO MALIGNANCIES WHERE FOUND THAT WOULD HINDER MY ABILITY TO PERFORM LABOUROUS JOB LOGISTICS. NOW THE COMPANY I WORKED FOR IS SAYING THESE INJURIES ARE NOT WORK-RELATED BUT PREEXSITED. MY QUESTION IS, HOW CAN A PERSON WORK WITH TWO FULL BLOWN HERNIATED DISK FOR 6-7 MONTHS AT 100% AND PUT IN OVERTIME AND NEVER MISS A DAY OF WORK? PLEASE ANSWER THIS QUESTION. THANK YOU.

Hi there

Thanks for the query

I have read your query and viewed the report.

Disc prolapse occurs in virtually everyone mainly contributed by age, degeneration and erect posture.

Your job may not have directly contributed to disc prolapse because these changes can take place in a person who does not do your job as well.

A work related injury involves fractures, injury to limb, eyes etc. But a slip disc can occur as part of normal degenerative changes in every human being. It may not have occured due to the fall as well.

I hope I have answered your query.

I will be available to answer your follow up queries.

Regards,

Aashish Raghu
