Brief Answer:
Abandonment

Detailed Answer:
Thank you for contacting HCM with your health care concerns

I find it unconscionable to discharge a patient because they can't stop smoking. I would call this abandonment to discharge a patient for smoking. Unless you have a health contract with the doctor stating that you would stop smoking he can't discharge you. He could discharge you if you had a pain contract and violated that contract.

If you have no other recourse with this doctor then I would report him to the State medical board for abandonment and look for a new doctor. You may need to see a chronic pain specialist to help with your back issues.
