she has been laying down alot and whimpering. No fever no nausea she has a bowl but cry's a lot during and says it hurts she is eating a little we are concerned about appendices ... she has for a long time most of her life complained about constipation but it seem much worse lately and her cousins about that age and her mother have constipation problems

Constipation could indeed be the cause but it needs proper clinical examination to be able to make out if that is the case. Intake of a fibre rich diet is essential in such a case. If there is family history of constipation, the cause needs to be evaluated and back up by proper supportive interventions. The pain in appendicitis is located specifically in the lower right abdomen. So, unless that is the case, it is not appendicitis. It is generally not a problem that is faced at this age. I would strongly suggest you to visit a pediatrician and to get your 5 year old evaluated. He will be able to assess the situation relating to the bowling accident.
